Special Restaurant Licenses or SFX licenses are issued in Miami Dade County pursuant to Florida Statute 561.20(2)(b), which means bona fide restaurants must have 4, 000 square feet of floor space under permanent cover and seating for 200 patrons, as well as derive at least 51% of the gross revenue from the sale of non-alcoholic beverages and food.
The same Statute regulates Special Hotel Licenses and requires hotels, motels or motor courts to provide 50 guestrooms or more and derive 51% or more of their gross revenue from the rental of rooms in order to be issued a liquor license. As far as the Historical Districts are concerned, licenses there are issues pursuant to Florida Statute 561.20(2)(a) 1 to establishments that have at least 100 guestrooms and derive 51% of their gross revenue from the rental of those rooms. Furthermore, the premises must be listed on the National Register of Historic Places, following the National Historic Preservation Act of 1966; 26 USCs, 48(g)(3)(B); or any locally established historic board or commission.
